Welcome to the Paul Davis Restoration, Inc. (“Paul Davis”) The Fire Safety Project Video Contest online website, www.thefiresafetyproject.com (the “Site”). This Terms of Use Agreement (the “Agreement”) between you and Paul Davis states the conditions for your use of the Site. By using the Site, you agree to abide by the policies and obligations set out in this Agreement. Paul Davis may make changes in this Agreement from time to time. We will notify you of any such changes by posting them here on the Site. Your continued use of the Site after such changes are posted signifies that you have agreed to the changes.

Intellectual Property

The content of the Site, including without limitation its text, trademarks, logos, graphics, designs, programming, applications, and software, is owned exclusively by Paul Davis or licensed to Paul Davis for use on the Site. The content of the Site, including its selection, assembly, and arrangement, is a collective work under U.S. copyright laws. You acknowledge and agree that the Site and its content are for your personal and non-commercial use only, and that you will not violate the intellectual property laws protecting Paul Davis by copying, modifying, republishing, distributing, creating derivative works from, or displaying any content from the Site without prior written permission from Paul Davis. Paul Davis grants permission for you to copy or download material from the Site solely for your personal, non-commercial use, and only if Paul Davis’ copyright notices are included in the copied or downloaded material.

Privacy

Paul Davis is committed to protecting the privacy and security of users of the Site and of any personal information you provide to us. Paul Davis’ Privacy Policy, incorporated by reference in this Agreement, explains our policies and practices for collecting, maintaining, using, sharing, and protecting your personal information.

Content

Paul Davis makes reasonable efforts to include accurate and up-to-date information on the Site. But we make no warranties or representations as to the accuracy, currency, or completeness of the Site and its content, and you agree that your access to and use of the Site and its content are at your own risk.

Neither Paul Davis nor any party involved in creating, producing, or delivering the Site shall be liable for any damages, including without limitation, direct, incidental, consequential, indirect, or punitive damages, arising out of your access to, use of, or inability to use the Site, or any errors or omissions in the content of the Site. This limitation includes damages arising from or related to any viruses that infect your computer equipment.

Indemnification

You agree to indemnify, defend, and hold harmless Paul Davis, its officers, directors, employees, agents, suppliers, and third-party partners from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation by you of this Agreement.

The Site may contain links or references to other websites maintained by third parties over whom Paul Davis has no control. Such links are provided merely as a convenience, and their inclusion on the Site does not imply any endorsement or recommendation by us. Paul Davis is not responsible or liable for the content of any such third-party websites or for the products or services available there. We make no warranties or representations as to the accuracy, currency, or completeness of any information contained in such third-party websites. Each third-party website has its own terms of use, which may differ from those of Paul Davis, and you assume all risks arising from your use of any such websites.

Governing Law, Jurisdiction, and Venue

This Agreement and your use of the Site are governed by the laws of the United States of America and the State of Florida without regard to its conflicts of laws principles. You agree that the sole and exclusive jurisdiction and venue for any legal action or proceeding related to the Site or to this Agreement shall be a court in Duval County, Florida or the United States District Court for the Middle District of Florida, Jacksonville Division, and you waive any objection you may have to that jurisdiction and venue.

Waiver and Severability
The failure of Paul Davis to enforce any right or provision of this Agreement will not be deemed a waiver of that right or provision. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of the Agreement will remain in full force and effect.
